Our store is powered by Shopify. Purchases made through this website are contracts with Zoomball’s legal owner.

These Terms apply together with the information provided before checkout and our Return and Refund Policy, Shipping Policy, and Privacy Policy.

Nothing in these Terms excludes or restricts mandatory consumer rights.

2. Eligibility and account information

You must have the legal capacity to enter into a purchase contract and be authorised to use the payment method provided.

Please provide accurate contact, billing, and delivery information. If you create an account, keep your login details secure and notify us of suspected unauthorised access.

You are responsible for your own conduct, but not automatically for activity outside your control or failures attributable to us.

3. Products and safe use

Zoomball offers ball-shaped dog toys and any accessories expressly listed in the store.

The product page identifies the relevant characteristics, size, supplied accessories, operating requirements, and any stated limitations. Please check these before purchasing.

Use the product in accordance with its instructions and safety warnings. Select a toy suitable for your dog’s size and behaviour, supervise play, and regularly inspect the product. Stop using it if it becomes damaged or parts become loose.

Unless expressly stated otherwise, the product is a play toy rather than a chew toy. No claim of indestructibility is made.

For electrically powered or rechargeable models, follow the supplied charging and care instructions. Do not assume that the product is waterproof or suitable for immersion unless this is expressly stated.

Individual dogs may respond differently to the toy. A lack of interest does not, by itself, mean the product is faulty. This does not affect rights arising from misleading descriptions, defects, or failure to meet agreed characteristics.

These instructions do not remove our obligations concerning product safety and conformity.

4. Product descriptions

We take reasonable care to describe and display products accurately.

Screen settings and lighting can cause minor colour differences, but products must meet their descriptions and agreed characteristics.

Changes to descriptions, prices, or availability apply to future purchases and do not retrospectively alter accepted orders.

5. Placing an order

Select your products, review the cart, enter the requested details, and check the total before submitting payment. You can correct information before placing your order.

The final checkout button indicates that the order involves an obligation to pay.

An automated acknowledgement confirms receipt of your order. We accept it when we send an email expressly confirming acceptance or dispatch, whichever occurs first.

Before acceptance, we may decline an order for an objective reason, such as unavailable stock, an unsupported destination, unsuccessful payment, or reasonable indications of fraud. We will notify you and promptly refund any payment collected for an order we do not accept.

After acceptance, we will not change essential terms without your agreement or cancel the contract except where permitted by law.

Order information is sent by email. Please keep your confirmation and these Terms. You can contact us to request a copy of your order details.

The contract language is the language used in checkout and the order confirmation.

6. Prices and payment

The currency and total payable are displayed before you submit your order.

Taxes are included or separately displayed according to the rules applicable to the transaction. Where tax-inclusive consumer pricing is legally required, displayed prices include the applicable taxes.

Standard shipping is free to the destinations enabled at checkout.

Any additional charge collected by Zoomball must be disclosed before purchase. If import duties, taxes, or clearance charges may be payable separately by you, this must be clearly disclosed before you place the order. These Terms do not impose undisclosed import charges.

Price changes do not affect accepted orders.

Payments are handled by the providers available at checkout and are subject to their applicable payment terms.

7. Promotions and bundles

Discounts, bundles, and promotional offers are subject to the conditions displayed with the offer.

Check the products, quantities, and accessories included before purchasing. An accessory is included only where expressly stated.

Any rules affecting a partial return of a promotional bundle must be disclosed before purchase and comply with applicable law. We will not impose undisclosed penalties or restrict mandatory return rights.

8. Shipping and delivery

Orders are normally processed within 1–2 business days after payment confirmation.

After dispatch, estimated delivery is 5–10 business days. The total estimated timeframe from purchase to delivery is therefore 6–12 business days.

Business days exclude Saturdays, Sundays, and applicable public holidays. Any different estimate for a product or destination will be disclosed before purchase.

We ship to destinations available at checkout. If a significant delay occurs, we will inform you and explain the available options.

Carrier disruption, customs processing, or other events do not automatically remove our delivery obligations or your rights.

Where Spanish consumer law applies, unless another period has been agreed, delivery must take place without undue delay and within 30 calendar days after the purchase contract is concluded.

If delivery is overdue, you may require delivery within an appropriate additional period and cancel if delivery still does not occur. No additional period is required where applicable law permits immediate cancellation.

For US orders, where applicable shipping rules require a delay notice, consent to a revised shipping date, or cancellation and a prompt refund, we will follow those requirements.

For consumer purchases, the risk of loss or damage generally remains with us until you or a person you designate, other than the carrier, physically receives the goods. A statutory exception may apply if you independently appoint a carrier we did not offer.

A tracking entry alone does not conclusively establish receipt.

9. Address changes and cancellation requests

Check your delivery address before placing your order.

If you need to change details or request cancellation, contact zoomball@use.startmail.com as soon as possible. We will make reasonable efforts to help before dispatch.

Once preparation or shipping has progressed, an operational change may no longer be possible. This does not remove statutory withdrawal rights.

Any proposed additional cost arising from incorrect information you supplied must be reasonable, lawful, and explained before you agree to it.

10. Returns and refunds

You have 30 calendar days from receiving your order to request a return under our Return and Refund Policy.

Voluntary change-of-mind returns are subject to the condition requirements stated in that policy, including that the toy has not been used by a pet.

Those requirements do not restrict mandatory withdrawal rights or rights concerning faulty, damaged, or incorrect products.

Consumers in the European Union generally have 14 calendar days from receipt to withdraw from an online purchase without giving a reason, subject to statutory exceptions.

Change-of-mind return postage is paid by the customer unless we agree otherwise. Our return address is in Madrid, Spain, including for orders delivered to the United States.

Zoomball covers necessary return costs for faulty, damaged, or incorrect goods where required by law.

11. Defects and warranties

Products must meet applicable conformity and warranty requirements.

If a product arrives damaged, is incorrect, or fails during normal use consistent with its instructions and advertised characteristics, contact us with your order details and a description of the issue.

We will provide the remedy required by applicable law, which may include repair, replacement, a price reduction, or a refund.

Damage caused by misuse or ordinary wear does not, by itself, establish a defect. Equally, damage during use does not automatically establish misuse.

Where Spanish consumer law applies, new goods generally have a statutory conformity guarantee covering defects that become apparent within three years of delivery.

US customers retain any applicable federal and state warranty rights.

Any commercial guarantee expressly advertised with a purchase is additional to statutory rights and applies according to its stated terms. The 30-day return period does not shorten applicable warranty rights.

12. Errors and availability

If we identify an error affecting your order, we will contact you and explain the issue.

We will not substitute a product or charge a higher price without your agreement.

Errors affecting an accepted order will be handled according to applicable law. These Terms do not give us an unrestricted right to cancel purchases or avoid our obligations.

13. Shopify and third-party services

Shopify provides the technology supporting our store. Zoomball remains responsible for its obligations as the seller.

Independent third-party services may have their own terms. Providing a link does not, by itself, make us responsible for independently operated content.

This does not exclude responsibility for our own conduct or obligations that cannot lawfully be excluded.

14. Privacy

Our Privacy Policy explains how we process personal information.

Using the website or accepting these Terms does not, by itself, constitute consent to optional advertising, marketing, or non-essential cookies.

15. Intellectual property

Protected website content, branding, photographs, graphics, and videos belong to Zoomball or their respective rights holders.

You may browse and retain information reasonably necessary to evaluate a purchase, keep transaction records, or exercise legal rights.

Other commercial use, reproduction, or distribution requires permission unless allowed by law.

Third-party trademarks remain the property of their owners. Their appearance does not imply affiliation unless expressly stated.

16. Reviews and submitted content

Reviews must reflect genuine experiences and respect third-party rights. Any compensation or incentive must be appropriately disclosed.

When you submit content for public display, you grant us a non-exclusive, royalty-free licence to display and reproduce it in connection with our store and the relevant product, consistent with the purpose explained when you submit it.

Private customer service communications are not covered by this permission. Separate advertising use of your identity or images requires an appropriate legal basis.

We may remove content for an objective reason, such as illegality, spam, fraud, or disclosure of personal information. We will not remove a genuine review merely because it is negative.

17. Acceptable use and account restrictions

You must not use the website for fraud, impersonation, harassment, infringement, unauthorised data collection, malicious code, or interference with security.

We may take proportionate steps to address unlawful conduct, material breaches, or security threats. Where appropriate and legally permitted, we will explain the reason.

Account restrictions do not remove rights concerning existing purchases, refunds, warranties, or personal information.

18. Availability and liability

We take reasonable steps to maintain website availability and security, but access may occasionally be interrupted.

An interruption does not cancel accepted orders or remove our support, delivery, warranty, or refund obligations.

Nothing in these Terms excludes liability for fraud, intentional misconduct, defective products, personal injury where exclusion is prohibited, or any other liability that cannot lawfully be excluded.

You remain responsible for your own unlawful conduct to the extent provided by law. You are not required to assume liability for our own fault or accept disproportionate indemnification obligations.

19. Events outside our reasonable control

If an event outside our reasonable control prevents performance, we will take reasonable steps to reduce its effects and inform affected customers.

Such events do not automatically permit us to retain payment without supplying the goods or remove cancellation and refund rights provided by law.

20. Applicable law and disputes

These Terms are governed by Spanish law.

This choice does not deprive consumers of mandatory protections under the law applicable to their purchase, including relevant US federal or state protections and protections of their country of habitual residence where applicable.

Jurisdiction is determined by applicable law. Consumers are not required by these Terms to bring proceedings exclusively in Madrid or waive access to courts available under mandatory rules.

21. Changes and general provisions

Updates apply to future purchases. Existing purchases remain subject to the terms provided when the contract was concluded, unless a change is required by law or agreed with you.

If a provision is unlawful or unenforceable, it will be treated according to applicable law. The remaining provisions continue where the contract can lawfully remain in effect.

These Terms do not exclude binding product descriptions, advertising commitments, or mandatory rights.
